Evanston Firefighter Accused of Unwanted Sex Act Won't Face Charges

A 26-year-old woman claimed she was the victim of an unwanted sex act by an on-duty Evanston firefighter at Firehouse 1, 1332 Emerson St., in October.

No criminal charges will be filed against an Evanston firefighter after a woman claimed she was the victim of an unwanted sexual act while he was on duty at the firehouse, according to the Evanston Review.

The Cook County State's Attorney's Felony Review unit determined there was not enough evidence to support the woman's claims against the firefighter, who has been on leave since the incident and may still face internal discipline, the Review reports.

what does that actually mean... "has been on leave since the incident"? paid leave? I understand some sort of disciplinary action should be taken IF the allegations against the firefighter are true. However, IF he received paid leave, that sounds more like a vacation than disciplinary action. What ever happen to innocent till proven guilty? Sounds like he was guilty till proven innocent. He should have been allowed to work until the results of the drawn out investigation were complete. Then if guilty, take action, not remove him from duty, possibly giving him a paid vacation, while at the same time diminishing manpower for fire protection of residents... or... to cover the lack of manpower pay out unwarranted over time for other ffighers till this was resolved. Even if it's an unpaid leave the end result will prob be the same thing... back pay i/e paid vacation...

The firefighter was given paid leave likely because that' the contract the city has with the union. The reports I've read suggests the woman was in the fire station at 1 a.m. and that is a violation of departmental rules. It's nearly impossible to fire or demote a union employee. This firefighter will probably get a verbal reprimand and go back to work after his paid vacation.
