Evanston Man Found Not Guilty in 2010 Murder

Evanston resident John Anthony Bamberg Jr., 29, was found not guilty Friday in the shooting death of Marcus Davis in Evanston in 2003, according to the Chicago Tribune.

Bamberg was charged with first-degree murder after Davis, another Evanston resident, was shot and killed at age 23 in September 2010. Police say that Davis was pulling his car out of Smitty’s Garage, at 1422 Dodge Ave., when a gunman approached and fired multiple shots into the window. 

During trial proceedings on Wednesday, a prosecutor from the State’s Attorney’s Office said Bamberg had threatened to hurt Davis prior to the murder, according to the Tribune. 

But Bamberg’s attorney, David Olshansky, ultimately convinced the judge that there was not enough evidence to prove his client was the shooter, the Tribune reports. 

Speaking at a community vigil held shortly after Davis’ death in 2010, his sister, Tyra Davis, said her brother “lost his life for nothing, he didn’t have a chance to run away or defend himself.”
